PerliStream Terms of Use

These terms apply to the PerliStream apps, to PerliStream Connect and to the PerliStream Server software, published by Perlicom Systems Limited, a company registered in Ireland under company number 546999 ("we", "us"). By installing the app or creating a Connect account you agree to them. How data is handled is explained in the PerliStream Privacy Policy.

1. What PerliStream is

PerliStream plays media from a PerliStream Server that you or someone else runs. We supply the software and the account service that finds your servers; we supply no films, no series, no music and no television channels, and we have no copy of your library.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use PerliStream on devices you own or control, in line with these terms and, where you installed it from Google Play, the Google Play Terms of Service. You may not copy, sell, rent, sub-licence or redistribute the software, or reverse engineer, decompile or modify it, except where the law allows this regardless of these terms. We and our licensors keep all rights not expressly granted to you.

3. Your content is your responsibility

You are solely responsible for the media on your server and for having the right to hold it, to play it and to share it with the people you invite. Do not use PerliStream to store, stream or share material you do not have the right to, or that is unlawful where you or your members are. We do not monitor the contents of your server — we cannot: it is not ours — but we may suspend a Connect account or a server that we are told, or find, is being used to distribute infringing or unlawful material.

4. Your account and your servers

  • You must be 18 or over to create a Connect account. Keep your sign-in secure; you are responsible for what happens under your account, and you can sign a lost device out from the device list.
  • The person who claims a server owns it: they decide who is invited, what those members can see, and what the server keeps. If you join someone else's server, you are their guest and they can remove your access at any time.
  • If you own a server and share it, you are responsible for the people you invite and for anything their use of it involves.
  • You can delete your account from the app, which unclaims any server you own. Data held by a server is deleted by whoever runs that server.

5. Free version and advertising

The free version is supported by advertising provided by Google AdMob: a banner on the Account and library screens, and one full-screen ad when a title has finished and there is no next episode, as described in the Privacy Policy. There is no pre-roll, no mid-roll and no ad over the player. The television interface and the desktop app carry no advertising. Nothing about what you watch is shared with an advertiser. A paid plan removes advertising.

6. Plans and payment

  • A paid plan, where offered, unlocks features such as access from outside your own network, our relay, downloads for offline use, live TV and recordings, and extra family seats. What each plan includes is shown before you buy.
  • Checkout opens in your browser and is handled by our payment provider. Prices shown include VAT at the rate for your country.
  • A recurring plan renews at the end of each period until you cancel, which you can do in the app or by e-mailing support@perlicom.com; cancelling takes effect at the end of the period you have paid for. If a renewal payment fails we may downgrade the account to the free plan after a short grace period.
  • If you are a consumer in the EU or the UK you have a statutory right to withdraw from a purchase within 14 days. Where you ask for the service to start immediately, you may be asked to acknowledge that you lose that right once it has been fully provided. Nothing in these terms affects your other statutory rights.
  • Our relay is a fair-use service with a bandwidth limit; it is a fallback for when a direct connection is impossible, not a content-delivery network.

7. Acceptable use

You must not use PerliStream to break the law, to infringe anyone's rights, to share sexual content involving minors, to attack, overload or probe our services or anyone else's, to get around a licence check, a plan limit or a member restriction, or to access a server you have not been invited to.

8. Availability and changes

PerliStream depends on your server, your network, your devices and, for anything outside your own network, on our services. It can be interrupted, slow or temporarily unavailable, and playback quality depends on your hardware and connection. We do not promise it will be uninterrupted or error-free. We may update the apps and the server software, and change, add or remove features, to fix problems, improve the product or meet legal and store requirements. Where a change materially reduces something you have already paid for, we will give notice first.

9. Liability

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, and to the fullest extent the law allows: the software and the services are provided "as is" and "as available"; we exclude implied warranties; and we are not liable for lost profits, lost data, lost recordings, corrupted media, damage to equipment, or indirect or consequential loss. Our total liability to you in any twelve-month period is limited to the amount you paid us for PerliStream in that period, or €100 where you paid nothing.

10. Ending these terms

You may stop using PerliStream at any time by cancelling any plan, deleting your account and uninstalling the app. We may suspend or end your licence or your account if you materially breach these terms. Sections 3, 9 and 11 survive the end of these terms.

11. Governing law

These terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction, except that if you are a consumer you keep the protection of the mandatory laws of the country you live in and may bring proceedings there.

12. Third-party names

Google Cast and Chromecast are trademarks of Google LLC. Other names shown in the app belong to their owners and are used only to identify a device or a service. PerliStream is not affiliated with or endorsed by any of them.

13. Changes to these terms

We may update these terms as the product or the law changes, and will change the effective date above. Continuing to use PerliStream after a change means you accept the updated terms.
